«Statute of the Employers Guild Society of Stationery Manufacturers of Iran»
Chapter One – General Principles
Article 1- Objective:
With reference to Article 131 of the Labor Code of the Islamic Republic of Iran, and in enforcing the bylaw of guild societies and related associations, and in order to preserve the rights and legitimate and legal interests, and to improve the economic status of employers, which also entails the preservation of the interests of the community: this guild society shall be formed.
Article 2- Name, area of activity and legal domicile of the guild society:
Name: The Employer’s Guild Society of Stationary Manufacturers which is referred to as “Guild Society” in this Statute.
The activity area of the Guild Society: the geographical area throughout Iran and, if necessary, with the permission of the relevant authorities, is abroad, and the location of its head office is in No. 47, Second Floor, Zardouz Mall, Jame Mosque Alley, Ahangaran Bazar, 15 Khordad Avenue, Tehran.
Note 1- The Board of Directors may, at any time, change the legal domicile of the guild society in its scope of activity and, at the same time as informing the members, in the manner approved by the General Assembly, communicate in written form to the Ministry of Cooperatives, work and social welfare.
Note 2- highly circulated newspaper is to publish the notice of guild society of stationary manufacturer employers.
Article 3- Basic and General Duties of the Guild Society:
1. To strive for vindication of legitimate rights and demands of the members by creating favorable conditions for achieving the goals of the association.
2. Collecting information, researching and investigating problems, identifying needs and priorities.
3. Planning for the needs of the guild, training, development and expansion of activities.
4. Efforts to promote interests productivity and production capacity, transfer of technological innovation.
5. Trying to improve the quality of production, or evaluation, identify and deploy new methods of quality control.
6. Efforts to coordinate in education raise skills and provide required human resources, collaborate with the Ministry of Cooperatives, Work and Social Welfare, and other relevant institutions and organizations to carry out training on technical protection and health.
7. Organizing training classes for members.
8. Notification via social networking, web site creation and news bulletin.
9. Carrying out the necessary investigations and providing advisory and legal advice on the preparation of bills and plans related to the laws of labor and social security and welfare issues and the legal rights of employers to relevant authorities.
10. Receiving fee for entree, membership fees and voluntary financial contributions in accordance with the statute.
11. Collaboration to establish, strengthen and expand cooperative companies and interest-free loan funds related to the duties of the Guild Society to provide members with more facilities.
12. Supporting and defending the guild members’ professional rights and interests through proposing and provision and support by the authorities and national and governmental organizations in support of the goals of the guild.
13. Buying, selling and owning movable and immovable property of the guild society in the name and account of the guild on condition that it is not intended for business and interest.
14. Joining homogeneous guild societies in order to establish or join a union of professional guild associations in compliance with legal requirements.
15. Cooperating with other guild associations and performing other duties and authorities that are regulated by or under the laws of the guilds.
16. Accepting the responsibility and cooperation with ministries, organizations and official organs in carrying out the duties and assignments that these organizations give to guild associations and to be prepared to provide the necessary advice to them.
17. Establishment of association with organizations related to the duties of guild societies or related associations within the country within the framework of the activities of the guild and the laws and regulations of the country.
18. Participate in professional negotiations with other relevant employer organizations under the law and concluding collective agreements with labor organizations.
19. Continuous collaboration with knowledge-based companies and the use of new technology to improve the quality of products.
Article 4- Special Functions of the Guild Society
Follow up on the exercising of the government’s macro politics and legal regulations regarding the ban on the purchase of imported goods similar to domestic production by government departments.
Gaining support from government authorities towards guild goals
Prosecution and protecting manufactured goods registered in the Industrial Property Registration Office, as well as the enforcement of Article 28 of the Patent, Industrial Design, and Trademark Act of 2007.
Interaction with regulation bodies, including the Ministry of Industry, Mine and Trade, Consumer and Producers’ protection Organization, Guild Hall, Customs of the Islamic Republic of Iran, Central Headquarters for the fight against smuggling of goods and currency … In connection with consumers and manufacturer’s right protection laws, guilt service, fraud, customs, smuggling of goods, as well as the compilation of required rules, as well as the pursuit and introduction of experts to judicial authorities to deal with smuggled imported goods, counterfeit and similar to domestic products in order to protect the substantial and inward interests of members .
Collaboration with the National Standards Organization for the compilation and revision of mandatory standards, including the manufacture and import of goods and related to stationary industry
Efforts to create a framework for the production of stationaries that are suitable for the Iranian-Islamic culture and cooperate with regulatory agencies in organizing and regulating the market in this regard.
Interaction with Ministry of Industry, Mining, Trade and Customs of the Islamic Republic of Iran to prevent unreported imports, modification of the basic value and tariffs of imported goods
Interaction with the Tax Affairs Organization to reform the structure of tax taking from manufacturing units
Conducting exhibitions, internal and external congresses for the direct introduction or sale of products manufactured by members of the guild, as well as the establishment of direct distribution companies for the protection of consumer rights in accordance with the relevant legal provisions.
Information gathering, investigation and research in relation to the market of other countries for the export of products manufactured by members
Informing members of the rules and regulations of The Islamic Republic of Iran on the maintenance of consumer rights and the obligation of members to comply with them
Receiving, publishing and announcing rules of this profession between members.
Printing of specialized magazine after obtaining permission from competent authorities and distribution all over the country
Chapter 2
Membership condition, suspension, abdicate membership and financial resources of guild society
Article 5- Membership Conditions:
All real and legal people can join the gild society if they have the following conditions:
1- Iranian nationality
2- Employed in the profession or industry of stationaries in the field of guild society activities with the provision of authentic documents including: exploitation license – copy of identity card and birth certificate – latest changes of the official and formal newspaper – 3 a photo with 3 * 4 size
3- Following one of the official religions of the country.
4- Providing credible credentials for being employer in accordance with labor law.
5- Acceptance and commitment to implement the provisions of this Statute and the decisions and approvals of the guild society and members.
6- Payment of entree and membership fees on a regular basis.
Note 1: All Qualified Individuals can freely accept the membership of the guild and no one can be forced to join the Guild Society or ban the membership.
Note 2: The complaint regarding the non-acceptance of the applicant’s membership due to failure to meet the membership requirements of the board of directors or the suspension of the membership by the inspector is raised at the first meeting of the general assembly and the decisions of the Assembly are definitive in this regard.
Note 3 – If each member loses the requirements of membership of the guild society, he or she is deemed to be a resigned, but is required to fulfill his previous obligations.
Article 6 – Suspension or exclusion from the membership of the Guild Society:
1. Failure to pay for the membership fee determined in the due date accordance with Article 9 of this Statute (with the announcement of guild society’s financial liabilities).
